1. Seller identification and acceptance
This service is provided by Emerson Silva Monteiro ("Emerson Silva Monteiro", "we"). By creating an account and/or continuing to use Emerson Silva Monteiro, you state that you have read, understood and fully agreed to these Terms of Use and the Privacy Policy, forming a contract between you and Emerson Silva Monteiro. Continued use of the service after any update to these terms constitutes acceptance of the new terms. If you do not agree, do not use the service.
2. What TotalBody is (and is not)
TotalBody is an educational tool that generates workout and nutrition suggestions based on the information you provide. TotalBody is NOT a medical service, does not perform diagnoses, does not prescribe medication, and does not replace an in-person visit, exam or ongoing care from a physician, dietitian, physical therapist or fitness professional.
3. Medical disclaimer
Before starting any exercise program or dietary change, seek medical evaluation — especially if you have a chronic condition, cardiovascular disease, diabetes, hypertension, injuries, recent surgeries, are pregnant or postpartum, take medication regularly, have an eating disorder, or are over 60 years old. Stop any activity immediately if you experience chest pain, dizziness, abnormal shortness of breath, fainting or acute joint pain, and seek medical attention.
4. User responsibility and use of artificial intelligence
The quality and safety of the AI-generated suggestions depend directly on the accuracy of the information you provide in your health assessment and log entries. You agree to provide true and up-to-date information, to respect your own limits, and not to use the service for risky practices, extreme dietary restrictions or prohibited substances. You are solely responsible for the data you provide and for the decisions you make based on the AI outputs, which may contain inaccuracies, generalizations or errors and do not, under any circumstances, replace professional medical, nutritional or health advice.
5. Estimates and limitations
Metabolism calculations, body fat percentage and macronutrient estimates — including those based on meal photos — are AI-generated statistical approximations and may differ from reality. They should be treated as a reference, not a clinical measurement.
6. Prohibited misuse
You may not use TotalBody to: engage in illegal activity; commit fraud, send spam or impersonate another person; infringe our or third parties' intellectual property rights; attempt to interfere with, overload or compromise the security of the service; scrape, reverse-engineer or automatically extract data; or transmit viruses, malware or any malicious code. Violation of this clause may result in immediate suspension or termination of your account.
7. Intellectual property
TotalBody, its software, design, brand, texts, aggregated generated plans and other elements of the service are owned by Emerson Silva Monteiro and protected by intellectual property laws. No license is granted to you beyond a limited, personal and non-transferable right to use the service for your own purposes, in accordance with these Terms.
8. Service availability
We make reasonable efforts to keep TotalBody available, but we do not guarantee that the service will be uninterrupted, timely, secure or error-free. We may perform maintenance, updates or temporarily suspend features without prior notice, without this giving rise to any right to compensation.
9. Payments, subscription and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles all customer service inquiries and returns. By subscribing to or purchasing TotalBody, you also agree to Paddle's Buyer Terms, available at https://www.paddle.com/legal/checkout-buyer-terms, which govern the payment, billing, taxes and invoicing of your purchase.
10. Refunds and guarantee
We offer an unconditional 14-day guarantee: if you are not satisfied with TotalBody, you may request a full refund within 14 days of your purchase, with no need to provide a reason. To request a refund, contact us through your order dashboard at paddle.net (using the email used for the purchase) or via our contact page. Refunds are processed by Paddle, our Merchant of Record, in accordance with Paddle's Refund Policy, available at https://www.paddle.com/legal/refund-policy.
11. Suspension and termination of your account
We may suspend or terminate your account, with or without prior notice, in the event of a serious breach of these Terms, non-payment, or reasonable indications of fraud or risk to the security of the service or other users. You may close your account at any time via the contact page.
12. Limitation of liability
To the fullest extent permitted by applicable law, Emerson Silva Monteiro is not liable for injuries, health issues, losses or damages resulting from the use of the generated suggestions, especially when caused by omission of health information, failure to follow safety guidance, or lack of professional supervision. In no event shall our total liability exceed the amount you paid in the 12 months preceding the event giving rise to the claim.
13. Changes and termination
These terms may be updated at any time; material changes will be communicated in the app. You may close your account at any time via the contact page, which results in the deletion of your data.
14. Governing law and jurisdiction
These terms are governed by the laws of the Federative Republic of Brazil, with the courts of the user's domicile having jurisdiction over any disputes, without prejudice to the specific provisions of Paddle's Buyer Terms applicable to the payment relationship.
